jury for hacking Alaska Gov. Sarah Palin's e-mail.
FOXNews.com - A Democratic state representative's son has been indicted
by a federal grand jury in Tennessee for intentionally hacking into Alaska
Gov. Sarah Palin's personal e-mail account.
David C. Kernell, 20, was charged with one count of breaking
into the Republican vice presidential nominee's personal Yahoo e-mail account.
Kernell, an economics student at the University of Tennessee, is the son
of state Rep. Michael Kernell of Memphis.
According to the Justice Department, Kernell turned himself in
to authorities.
He pleaded not guilty in federal court in Knoxville, Tenn., on
Wednesday.
He was released without posting bond, but the court imposed several
conditions. Kernell is not allowed to own a computer and can only use the
Internet to check e-mail and do class work.
Trial is set for Dec. 16, and if convicted, Kernell faces up
to five years in jail and a $250,000 fine.
According to the indictment, Kernell, who used the nicknames
"rubico" and "rubico 10" on the Internet, allegedly reset Palin's e-mail
password to "popcorn" using Yahoo's password-recovery tool on Sept. 16
by "researching and correctly answering a series of personal security questions."
After changing the password, the indictment alleges he made screenshots
of her e-mail directory, e-mail messages and other personal information
before posting them to a public Web site. He also posted the reset password.
Kernell was able to obtain the personal e-mail addresses of Palin's
family members, pictures of her family, her birth date and at least one
family member's cell phone number. He also had access to her address book.
The indictment alleges that after posting Palin's personal information
online, Kernell "removed, altered, concealed and covered up files on his
laptop computer" to throw off a possible investigation.
Investigators were able to track Kernell down by tracing the
hack to his Knoxville apartment through an Internet proxy site.
The case is being prosecuted by the U.S. Attorney's Office for
the Eastern District of Tennessee and investigated by the FBI's Anchorage
and Knoxville field offices.

State Rep. Mike Kernell confirmed Thursday that his son, a University of Tennessee-Knoxville student, is at the center of heated Internet discussion into the hacking of the personal e-mail of vice presidential candidate Sarah Palin.
Kernell, a Memphis Democrat, confirmed that it is his 20-year-old son, David, who is being widely named on Internet blogs and chatrooms in connection with an unfolding story about Palin's hacked e-mail accounts.
The FBI and the Secret Service started a formal investigation on Wednesday into the hacking.
David Kernell is a student at the University of Tennessee-Knoxville. Mike Kernell said he spoke to his son on Thursday, as he does on a regular basis.
Kernell otherwise declined to comment, or discuss his sons whereabouts.

of David Kernell early Sunday morning. Kernell lives in the Commons apartment
complex at 1115 Highland Ave.
A Department of Justice spokesperson confirmed there has been “investigatory
activity” in Knoxville regarding the Palin case, but she said there are
no publicly available search warrants, and no charges have been filed.
A separate law enforcement source confirmed to 10 News that a search
warrant was served on Kernell’s apartment.
According to the witness, several agents arrived at The Commons of
Knoxville around midnight.
They presented their badges upon entering Kernell’s apartment, where
several students were having a party, and took down their names.
The witness tells us they asked him and those who did not live in the
unit to go outside. He believes the investigators took about 1.5 to 2 hours
taking pictures of everything inside the apartment.

A person who identified himself as a witness tells WBIR-Knoxville that agents with the FBI served a federal search warrant at the Fort Sanders residence of David Kernell early Sunday morning.
David Kernell is the son of Mike Kernell, a Democratic state representative from Memphis.
Laura Sweeney, a Department of Justice spokesperson, confirmed there has been "investigatory activity" in Knoxville regarding the Palin case, but she said there are no publicly available search warrants, and no charges have been filed.
A separate law enforcement source confirmed to WBIR that a search warrant was served on Kernell's apartment.
According to the witness, several agents arrived at The Commons of Knoxville around midnight.
